Better Brain BOOST™ Beta Release and Hold Harmless Agreement
Effective Date: September 15th, 2026
Better Brain BOOST™ is a trademarked brain-health application made available by Dementia Society, Inc., d/b/a Dementia Society of America (“DSA”) and powered by software developed and operated by Remembrance Health, LLC (“Remembrance Health”). The application may combine a web-based experience with one or more telephone calls, questions, activities, scoring methods, tracking tools, educational materials, or related features (collectively, the “Application”).
By clicking the “CONTINUE” link or otherwise accessing, registering for, using, or participating in the beta version of Better Brain BOOST™, you acknowledge that you have read, understand, and agree to this Beta Release and Hold Harmless Agreement (“Agreement”). Clicking “CONTINUE” has the same legal force and effect as signing this Agreement electronically.
Beta status and no medical purpose
You understand and agree that Better Brain BOOST™ is an early-access beta version that may contain errors, interruptions, inaccurate results, incomplete functionality, changes, or discontinuation without notice. The Application is offered for informational, educational, wellness, and research/development purposes only.
The Application is not a medical device, diagnostic tool, treatment, clinical evaluation, professional medical opinion, or substitute for care from a qualified physician, psychologist, neuropsychologist, or other licensed health-care professional. Results, scores, trends, recommendations, or communications generated through the Application do not diagnose, rule out, prevent, treat, or predict Dementia, major neurocognitive disease, cognitive impairment, depression, stroke, or any other condition.
Do not delay, avoid, start, stop, or change medical care, medication, treatment, or safety decisions based on the Application. If you have concerns about memory, thinking, mood, functioning, safety, or an urgent medical condition, contact an appropriate health-care professional or emergency services immediately.
Assumption of risk and release
To the fullest extent permitted by applicable law, you voluntarily assume all risks associated with use of the Application, including risks arising from inaccurate, incomplete, delayed, unavailable, misunderstood, or misapplied information, scores, assessments, communications, technical failures, or third-party services.
You release, waive, discharge, and agree to hold harmless DSA, Remembrance Health, and each of their respective officers, directors, employees, volunteers, contractors, agents, affiliates, successors, and assigns (collectively, the “Released Parties”) from any and all claims, liabilities, losses, damages, costs, expenses, or causes of action arising out of or related to your access to, participation in, reliance upon, or inability to use the Application, except to the extent caused by a Released Party’s gross negligence, willful misconduct, or liability that cannot legally be waived.
User responsibilities and privacy
You agree to provide accurate information, protect your account credentials, and use the Application only for lawful and intended purposes. You will not use the Application as a basis for making medical, emergency, employment, insurance, legal, financial, caregiving, or other high-stakes decisions.
Your use of Better Brain BOOST™ is also subject to the applicable Privacy Policy and Terms of Use, including information describing how data may be collected, used, stored, protected, and shared. Do not submit information that you are not authorized to provide.
Governing terms
If any part of this Agreement is found unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law. This Agreement is governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law principles, unless applicable law requires otherwise.
BY CLICKING “CONTINUE,” YOU CONFIRM THAT YOU ARE AT LEAST 18 YEARS OLD, HAVE READ THIS AGREEMENT, UNDERSTAND ITS TERMS, AND VOLUNTARILY AGREE TO BE BOUND BY IT.
